The Trade Employee's Day, which is commemorated on September 26 in Argentina, was established so that the employees of the sector could enjoy a day of rest, as provided by Law No. 26,541, enacted on November 11, 2009, ratified by the provision of the National Directorate of Labor Relations 759/2021.
It is celebrated in memory of the date on which Law No. 11,729, which legislates labor relations, was sanctioned in 1934.
Commercial employees, according to the Collective Bargaining Agreement (CCT), are considered to be those considered to be master and service personnel; administrative personnel; auxiliary personnel performing repair, execution or service tasks of any kind; specialized auxiliaries with special knowledge or skills in techniques or arts; and sales personnel.
Those who work in this area will be able to enjoy the holiday. Therefore, workers have the right not to work on that day, which means that some stores will not open their doors.
However, since the merchants or owners of the premises have the right to open their businesses in the same way, employers who decide to open to the public may ask their employees to work on that day. If they do so, they must be paid as a worked holiday.
